Holder: Drone strikes against Americans on U.S. soil are legal

Whoa!

Quote:
“It is possible, I suppose, to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States,” Holder replied in a letter yesterday to Paul’s question about whether Obama “has the power to authorize lethal force, such as a drone strike, against a U.S. citizen on U.S. soil, and without trial.”

[Rand] Paul condemned the idea. “The U.S. Attorney General’s refusal to rule out the possibility of drone strikes on American citizens and on American soil is more than frightening – it is an affront the Constitutional due process rights of all Americans,” he said in a statement.
I like the response by Clarity2016 to this:
"I have a feeling a large majority of Americans would support a Constitutional Amendment outlawing the use of drone strikes on American soil against our citizenry. Why don't we just pass that so that there isn't any ambiguity for Mr. Holder?"

Sounds like a good idea.

Too much talking, not enough inventing. In five years, when these things are flying around everywhere you'll look back on this moment and kick yourself in the arse for not getting on it.

Don't waste your time with that thought or idea. Drones with wireless streaming will be less than $10K within 5 years. These will be capable of flying at 1000 feet and reading your facial expressions yet are the size of a TV. All available in retail. Its going to change many things in our society.

The government/spy ones will be smaller than a lunchbox. Nothing but a flying camera.

Did the kid ever get anything worse than a C after this rule was implemented? Not a chance.

I'm not saying it's morally right or wrong, but does it make the child because of it? Think about that for a second.

I think there would be a lot of things to hash out in the law if that were so.

Beyond privacy, what about accidents and possible damage to person or property.

If someone came across a grounded one, they might think finders-keepers applies.

I'm talking about something that fools or tricks the drone in order to cloak one's privacy.

BTW, there is no way they will allow personal drones.

For one, there are a bunch of regs set up for airspace.

Then we need new laws. How about air around one's home is protected for privacy.

But what if there was a new technology that could warp what the drone sees through some field manipulation.

Obama ordered to divulge legal basis for killing Americans with drones

Quote:
The Obama administration must disclose the legal basis for targeting Americans with drones, a federal appeals court ruled Monday in overturning a lower court decision. The appeals court decision, meanwhile, comes two weeks after a District of Columbia federal judge tossed a lawsuit against the Obama administration brought by survivors of drone strikes in Yemen more than two years ago in which three Americans—one a teenager—were killed.

US District Judge Rosemary Collyer, siding with the administration, ruled that allowing the human rights case to proceed "would impermissibly draw the court into the heart of executive and military planning deliberation."

Holder needs to be sent to prison.

I like how he basically came out the other week and said that the reason this admin gets all the bad press is because him and BO are black.

What a ****in joke this guy is.

When you have nothing left, resort to the race card.

They'll just claim executive privilege if it comes down to it.

I find it hard to believe the court doesn't see the danger here. Of course, if these people were working with Al Queda then fine, they are enemy combatants and killing them is reasonable. But if the white house doesn't even have to answer questions about why they did it, where are we going to go from there?

If the administration can just kill a citizen without needing to divulge the basis on which they did it, why would they ever build a case against someone or take them to trial? Send the Reaper after them and it's all tied up with a nice little bow.

I agree, but there could be problems with mentioning specific informants, people who are under cover, how they tracked someone, what groups have been infiltrated, etc. If you have people working for you inside a certain Al Queda cell or something, you don't really want that info known publicly.

What you raised are valid concerns, and there's probably no real way to resolve it without a lot of people complaining either way.
Anyway, I thought they did release the legal justification for these actions.

I agree that in at least some cases this is true, but this is not a new problem, it's a problem that the FBI and domestic police entities also face.
