Gabby Gifford's Husband CAUGHT buying AR-15!

http://www.breitbart.com/Big-Governm...mpaign=foxnews

Quote:
Mark E. Kelly, gun-control proponent and husband to former Congresswoman Gabby Giffords, recently purchased an AR-15 (an "assault weapon," he called it)—which he now says he intended as an illustration of the need for more stringent gun laws.

Kelly reportedly bought the AR-15 and a 1911-style semi-automatic pistol at a gun store in Tucson, Arizona.

Breitbart News received a tip on this when Neil McCabe, editor of Guns & Patriots newsletter, contacted us on March 7 and said:

Mark E. Kelly, made purchases which included an AR-15--sometimes described as an "assault rifle"--at 3:30 pm on the afternoon of March 5 at Diamondback Police Supply, 170 S. Kolb Street, Tucson, AZ.

According to McCabe, witnesses to the purchases claimed Kelly purchased "high capacity" magazines as well.

On March 6, McCabe contacted Kelly's gun control group--"Americans for Responsible Solutions"--and on March 8 they replied that his message had been passed on to colleagues who handle press requests. Breitbart News then began investigating the details surrounding the purchase, including visiting the gun store.

Suddenly, Kelly announced on his Facebook page that he was not going to keep the AR-15, which he has yet to pick up from the store.

Days after making the purchases, Kelly wrote on Facebook:

I just had a background check a few days ago when I went to my local gun store to buy a .45. As I was leaving, I noticed a used AR-15. Bought that too. Even to buy an assault weapon, the background check only takes a matter of minutes. I don't have possession of it yet but I'll be turning it over to the Tucson PD when I do.

.....cont'd....see link for more

If I remember right the form doesn't specify that. It asks if you are buying this for yourself. Falsely filling out the form is a fed offense. I don't believe the legal status of the final recipient matters. I could be wrong though.

I'm trying to figure this out myself.....I believe it might vary by state...but still not 100%. In my state ( communist california) you have to state whether it is a gift at the time of purchase, and possibly even indicate who it is for...I am 99% sure. Other states may be more lax...or it might be a federal issue. If there IS a gift section on the form in AZ , then it would be a crime to fraudulently fill it out.

I found a link (via Wikipedia) to a PDF document from the ATF.
  1. "ATF P 5300.4 - Federal Firearms Regulations Reference Guide 2005 General Information discusses "straw purchase" on p. 165 (application/pdf Object)".
The Wiki entry states:

Firearms

Straw purchases can be illegal in the United States when made at a federally licensed firearm dealership. If the straw purchaser of the firearm lies about the identity of the ultimate possessor of the gun, he can be charged with making false statements on a federal Firearms Transaction Record. If a firearm is purchased as a gift, the purchaser must indicate the intended recipient on the transaction record. Straw purchases of used guns are not illegal, unless the gun is used in a crime with the prior knowledge of the straw purchaser.[1]
http://en.wikipedia.org/wiki/Straw_purchase#cite_note-1

And uses the PDF document (page 165) as a footnote (1).

Kelly is a hypocrite but he is not a straw purchaser. If you look at the actual reference(and I am looking at my FFL ref hardcopy) it says the following....

Quote:
Where a person purchases a firearm
with the intent of making a gift of the
firearm to another person, the person
making the purchase is indeed the true
purchaser. There is no straw purchaser
in these instances.
In the above exam-
ple, if Mr. Jones had bought a firearm
with his own money to give to Mr. Smith
as a birthday present, Mr. Jones could
lawfully have completed Form 4473.
The use of gift certificates would also
not fall within the category of straw pur-
chases. The person redeeming the gift
certificate would be the actual purchaser
of the firearm and would be properly
reflected as such in the dealer's records.
There is no straw purchase even if the gift recipient is not included on the 4473.

He's a total douchebag, but not a known criminal yet.

Youth Baseball Team Raffling AR-15 Rifle

Cowboy Byte

A youth baseball league in central Illinois is in desperate need of cash – so they’ve decided to auction off an AR-15 assault rifle.

Last year the Atwood-Hammond baseball league tried to raffle off half a hog. But they only raised $10 – and barely had enough to pay the local butcher.

So this year a local gun shop provided the league with a Rock River Arms Tactical Operator Two – and the response has been massive.

“My phone has been ringing off the hook,” said Charidy Bucher, co-owner of the Atwood Armory shop. “The response has been tremendous.”

Bucher told me her phone has been ringing since 4:30 a.m.

“People from out of state have been calling,” she said.

She said the winner of the rifle will also receive 260 rounds of ammunition.

“Ammo is just as hard to get as the firearms these days, unfortunately,” she said.

The towns of Atwood and Hammond are about 25 miles southwest of Champaign – where many residents invoke their Second Amendment rights.

“Most people in central Illinois like to go out and shoot with their families,” she told Fox News. “People are interested in preserving their rights to keep and bear arms.”
