JERSEY SHORE-- A Toms River 6-year-old who was shot in the head by a 4-year-old was reportedly in serious condition Tuesday, according to Toms River police.

Other weapons were found at the scene of the Monday night shooting that occurred in the McCormick Drive yard of the 4-year-old, according to Toms River Chief of Police Michael Mastronardy.

Mastronardy said that the boy obtained a .22 caliber rifle from inside the residence. The state Division of Youth and Family Services were also called to the scene because there were three other children in the home.

The parents were "nearby" when the incident occurred, the chief said. The mother of the 4-year-old called 911.

The 6-year-old was flown to Jersey Shore Medical Center in Neptune with a head injury and was in serious condition, the chief said.

The shooting occurred in the Cedar Grove area of the township, according to Toms River schools Assistant Superintendent James Hauenstein, who received the news during a New Jersey School Boards Association meeting Monday night.

The children were outside the home when the 4-year-old boy went inside to get the rifle, and then shot the 6-year-old about 15 yards away, the chief said. Mastronardy did not say if the 4-year-old pulled the trigger, or if the rifle accidentally discharged.

The 4-year-old's parents were home at the time, but no names have been released.

Authorities were on scene at a McCormick Drive home Monday night and had the yard cordoned off with yellow tape. Toms River police and county vehicles remained on the scene.

Hauenstein said that the victim is a student at Saint Joseph's Grade School. He said that Toms River schools officials will be available to provide counseling services to students at Cedar Grove Elementary and Saint Joseph's.

Toms River Police Department Detectives Louis Santora and Roger Hull are investigating along with the Ocean County's prosecutor's office and sheriff's department, Mastronardy said.

A rigorous background check would have revealed that the shooter was four years old.

Good thing the parents were "nearby".

I suppose that makes sense in no way whatsoever.

probably got it using a gun show loophole.
The parents are horrible; they should never let a kid go to a gunshow alone.

Darwin wins, you would think a 6 year old would be a faster draw and defeat the 4 year old.

NJ police: 6-year-old dies a day after being shot -- by a 4-year-old
By Julia Talanova and Laura Batchelor, CNN
updated 9:28 PM EDT, Tue April 9, 2013

(CNN) -- A 6-year-old New Jersey boy has died after being shot in the head by a 4-year-old playmate, Toms River police Chief Michael Mastronardy said.

Brandon Holt was pronounced dead at 5 p.m. Tuesday at Jersey Shore University Medical Center in Neptune, according to Mastronardy.

It was the second incident in the United States in recent days involving young children accidentally shooting others.

In Toms River, Brandon and another boy were playing in the yard of the 4-year-old's home Monday evening. The younger child left the yard, went inside his family's house, retrieved a .22-caliber rifle and returned to the yard, according to Sgt. Robert Rankin of the Toms River police department.

While the parents of the 4-year-old were in the yard nearby, the boy emerged with the rifle and a shot rang out, Mastrondardy said earlier Tuesday.
"It's really difficult to deal with," Daniel Watkins, uncle of the 6-year-old boy, told CNN affiliate WCBS. He said the two children were friends. "This is something that shouldn't have happened. It's horrible."

The Ocean County prosecutors office is investigating the incident to determine whether charges will be filed.

On Saturday in Tennessee, the 48-year-old wife of a deputy sheriff died after a 4-year-old boy shot her, authorities said.

The deputy sheriff was showing a relative some of his guns at the deputy's home when his wife and the child came into the room. The child managed to pick up a loaded handgun and fired a single shot, killing the woman, authorities said.
