Student charged with felony and expelled for forgetting unloaded shotgun in car





PRINCETON, N.C. (WTVD) -- According to law enforcement officials, punishments are not the same for students and school administrators who commit crimes on school property in Johnston County.

One day after a Johnston County high school senior was expelled for having an unloaded gun on campus, ABC11 learned administrators only suspended an assistant principal at the same school for a similar incident last year.

David "Cole" Withrow is a Princeton High School honors student who was arrested Monday and charged with a felony for having a shotgun in his truck in the school parking lot. Sources told ABC11 the Eagle Scout forgot it was still in the truck after skeet shooting over the weekend.

ABC11 has uncovered that two school officials both brought guns onto school property in recent years, but were never charged with felonies like Cole.

An assistant principal at Cole's school was suspended for three days, but never criminally charged. She still works in the same position at the school.

"I think it's wrong, if an assistant principal can bring a loaded handgun and doesn't get punished? No, unacceptable," parent Nancy Terry said.

A teacher at another high school in the school district was cited and resigned.

The students and parents in the community are outraged that Cole has received such harsh punishment for what he said was an accident.

"I don't have any problems with the assistant principal, but it's still not fair. Students and teachers should get treated the same," one student said.

The Johnston County Sheriff's Office told ABC11 that if a school administrator brings a gun to school, they will be charged with a misdemeanor. For a student, the charge is an automatic felony.

The school district would only say that they are following the law.

Now "Free Cole" has exploded in the small town thanks to all the people rallying behind the student.

"Everyone makes a mistake, he tried to do the right thing by it and it's upsetting," student Tyler Pope said.

For now, Cole's future is uncertain. He was admitted to Campbell University and East Carolina University to attend school in fall. He was also awarded a scholarship, but because he is currently charged with a felony it is unclear what will happen.

Another example of the stupidity of zero tolerance policies.

As for the felony, I have to believe the charges will end up reduced or suspended.

Of course, school administrators as members of a teachers union, are above the law for infractions far more serious (bringing loaded weapons to school)...

Students will find themselves being used as an example to the general populace for minor violations...

Hitting a little closer to home, my little cousin, once removed [is that how it works for direct cousin's kid?] in 2nd grade was defending a kid with Downs in his class [his aunt on his dad's side had Downs and passed away this winter].

Went to the teacher twice about it, who did nothing. Never resorted to violence/brawling, etc.

Anyway come lunch time, he made the grievous mistake of pulling the ol' thumb forefinger fake pistol maneuver. Now he's in counseling and a week of In School Suspension.

Do you know what % of teachers are in a union these days?

According to: http://www.teachersunionexposed.com/state.php, it's from 0-20% of the teachers in North Carolina.

Besides that, though, this incident is a crock of shit, and I sincerely hope that the "punishment" gets changed.

Everyone arguing the pro-gun side (myself included) says that we don't need new gun laws until we enforce the ones we have. Here, when the existing laws are enforced, these same people are bitching about enforcing existing gun laws.

You don't get to bring a ****ing shotgun to school if you're a student. PERIOD

I don't give a **** what the excuse was...and even if I did, "I forgot I left my gun in my car" isn't exactly a strong defense.

He was rightfully expelled. I don't expect him to serve jail time. This is a non-story.
