Obama administration suing to force companies to hire criminals

Apparently being a convicted criminal is now a protected class:

http://www.foxnews.com/politics/2013...al-background/

Seems silly to me....if a company does not wish to hire employees with a criminal record, they should not be forced too. Is Obama going to cover the business's losses when a criminal decides to help himself to the cash register?

The old saying is absolutely true - "Bad facts make bad law". Taking BMW's conduct here and using it to create law built around disparate impact is reckless and stupid. It's created very serious questions regarding exactly what can and cannot be asked, but the holding presently indicates that nothing can be asked safely.

In an attempt to punish BMW for engaging in surgery by shotgun, the courts created an overly broad legal fiction that now prevents employers from being able to ask questions that they should be able to ask without fear of staring down the barrel of a damn civil rights complaint.

I personally don't mind what BMW did, but I can understand those that do. The problem here is that a shortsighted court has issued a piss-poor holding as the remedy to that conduct and it's going to have implications far beyond just BMW's hiring practices.

Bad facts made really really bad law.
Perfect post.

If I don't want you to work for my company, you won't. And there isn't a damn thing you or anybody else can do about it. I do not discriminate on any protected class. I don't care if you're old, disabled, female, foreign national, or whatever. The only thing I care about is. "Can you do the job."

If I am a private employer I feel I should be able to hire or not hire anyone I want. If my landscaping company turns out to be predominately young attractive woman that prefer to work in a bikini then so be it. What I might lose in production could easily be recouped in public demand for the services. In either case as the business owner, it should be my choice. I might or might not choose to hire someone with a criminal record depending on what the conviction was, when it what and if it is relevant to the job. Since Government Jobs are paid by the public from taxes I don’t think it proper to discriminate based on Race, Religion, likes or dislikes the penis and so forth but, think a criminal record should be looked at in a common sense manner. Yes I realize common sense and the Government rarely belong in the same sentence but a DUI conviction 10 years ago shouldn’t necessarily prevent a person from being hired by the Government as a computer programmer. That sort of thing.

The problem here is that we put people in jail for everything here. If everyone is a criminal...then the word no longer has any meaning. Like the word "Sex Offender". It used to mean rapists and pedos. Now it means someone that took a leak outside.

Number 1 in the world in incarceration rates!

Not bad for a "free" country.

Well, that has something to do with the War on Drugs...so that could be handled.

Even if it ended yesterday, the impact of the incarceration of such large segments of citizens, who are otherwise law abiding, over the last thirty years has and will continue to negatively impact our society and economy.

But hey, assist seizure is big business.

I don't understand your last line. Do you mean asset seizure?

I don't see how this impacts our economy though. But that would be hijack to dig into.

Being convicted of a felony isn't exactly happenstance.

The vast majority of criminal complaints end up in misdemeanor convictions at worst. If you've been convicted of a felony offense, you've pretty much given the law the bird.

Yes to the first part.

You don't see how labeling large chunks of our workforce "criminal" or "felon" wouldn't negatively impact our society through increased cost of social services and decrease in tax revenue because cons are restricted to the lowest level of the workforce?

Not to mention the cost to government to bring to court, try, and convict, then house and feed these people.

The lost production and labor while more and more Americans are behind bars, not buying, not producing. The lost education opportunities.

I got a list a mile long. I haven't even touched on the negative effects prison has on people as well.

The adults are trying to have a conversation.

Go hang out with bump and bemoan the fact that you can't get a dime sack at the local QT.

Did you get your Drug terminology from reefer madness?

Or perhaps other works of fiction?
