UVA student Elizabeth Daly cleared of charges from water-buying incident

A trip to the grocery store turned into a nightmare for one University of Virginia student last April.

Elizabeth Daly, 20, was confronted by six men and a woman after she left a Harris Teeter in Charlottesville. She had just bought bottled water, cookie dough and ice cream, The Daily Progress reports.

As she was walking to her car, she was approached by a group of state Alcoholic Beverage Control agents wearing plainclothes. The agents thought that the water bottles Daly was carrying was a 12-pack of beer.

Police say one of the agents jumped on the hood of her car. She says one drew a gun, the Progress reports. Daly did not know who the agents were, so, she tried to rush out of the dark parking lot.
Daly was with her two roommates.

"They were showing unidentifiable badges after they approached us, but we became frightened, as they were not in anything close to a uniform," Daly said in a written account of the April 11 incident.

“I couldn't put my windows down unless I started my car, and when I started my car they began yelling to not move the car, not to start the car. They began trying to break the windows. My roommates and I were ... terrified," Daly said.

Agents charged her with two counts of assaulting a law enforcement officer and one count of eluding police. All of the charges were Class 6 felonies carrying a maximum penalty of five years in prison and $2,500 in fines per offense. She had to spend the night after the incident in the Albemarle-Charlottesville Regional Jail.

The charges against Daly were withdrawn on Thursday.

It isn't about how seldom it happens, thus making it news, but instead that it happened at all. Seriously... they are "cops", right?

Instead of drawing their firearms, jumping on the hood, and choking out a teenage girl. They could have easily followed them out of the parking lot and thrown on the lights. Or, since they are "cops" and not cops, they could have followed out of the lot and called for a REAL cop to come out and throw up the lights.

This could have been handled eleventyBIL!ION times better than it was. The fact that this happened at all is disgusting.

The OP is hyperbole. 1975 Rhodesia was a police state. Cold War East Germany. North Korea. Airstrip One. Those are police states. This is a specialized police department with what seem like bad procedures, bad tactics, and overzealous agents.

If we were living in a police state, we would know it. We wouldn't be able to criticize the cops on a web forum, for one thing.

The police are becoming more militarized. The image of Officer Friendly in his pressed blue slacks is giving way to a half-squad of helmeted shock troops storming down your apartment hallway. They are now taught to assume that anyone they meet could pull a weapon and start firing (probably because many people they meet pull a weapon and start firing). So, while it is true that:

The horrible encounter in the parking lot is a good example of something that would happen in such a society though. Idiots abusing authority for absolutely no reason whatsoever.

I think the original post was a lot broader than ABC cops.....

A few posts back, someone posed the question, do we think that the US is a police state?

I think a lot of things have happened over the past 10-15 years, somewhat slowly, where we've awoken in 2013 to a radically different USA than what it was in 2000 (as it relates to law enforcement at various levels).

I just read this story this morning......and I'm shocked, but I'm not shocked.
