The funniest part about the penalty is the only way the IRS can make you pay it is deduct it from any refund you are eligible for. They have no teeth to collect it any other way.

GOP Rep: Defunding Obamacare Is 'Off The Table'

Rep. James Lankford (R-Okla.) acknowledged Thursday the fight to defund the Affordable Care Act is over for now.

"That's currently off the table now," Lankford told CNN's Jake Tapper. "That's obviously not going to happen at this point."

The Oklahoma Republican said the GOP had shifted its focus to seeking a one-year delay of Obamacare's individual mandate.

The last offer House Republicans made on a government funding bill tied a continuing resolution to a one-year mandate delay and banning federal health care subsidies for members of Congress and their staffs. GOP leadership is still seeking those reforms, but has shifted its focus to deficit reduction talks in exchange for a six-week extension of the debt limit.

Conservatives like Rep. Raul Labrador (R-Idaho), on the other hand, weren't as willing to concede that Sen. Ted Cruz's (R-Texas) big defund-Obamacare gambit had been a total loss. Labrador didn't specify what Obamacare concessions he hoped to get at this point, but told reporters Thursday the new debt-limit offer was a prime opportunity to refocus the budget debate around the health care law.

So if there is an individual mandate, then there will be premiums paid by those who sign up and penalties paid by those who don't and who are not otherwise exempt by income or other reason.

If there are no penalties assessed then the amount of penalty money is not paid into the system. And, there would likely be less premiums paid because more people would take the chance of not getting insurance than there would be if individual penalties would be assessed.

If the GOP wants a one year delay in assessing penalties against individuals because the businesses got a one year delay in assessing penalties then they ought to agree to an appropriation to replace the lost premiums and penalties that would have been paid.

Unless, of course they are just trying to sabotage things. If that is what they are trying to do, then good luck reaching a compromise.
