Capital One says it can show up at cardholders’ homes, workplaces

The credit card company’s recent contract update includes terms that sound menacing and creepy.

Credit card issuer Capital One isn’t shy about getting into customers’ faces. The company recently sent a contract update to cardholders that makes clear it can drop by any time it pleases.

The update specifies that "we may contact you in any manner we choose" and that such contacts can include calls, emails, texts, faxes or a "personal visit."

As if that weren’t creepy enough, Cap One says these visits can be "at your home and at your place of employment."

The police need a court order to pull off something like that. But Cap One says it has the right to get up close and personal anytime, anywhere.

Rick Rofman, 71, of Van Nuys received the contract update the other day. He was spooked by the visitation rights Cap One was claiming for itself.

"Even the Internal Revenue Service cannot visit you at home without an arrest warrant," Rofman observed.

Indeed, you’d think the 4th Amendment of the Constitution, which guards against unreasonable searches and seizures, would make this sort of thing verboten.

Apparently not.

Actually, I would not think that at all.
Comparisons of Cap One to the police and IRS show a real cluelessness on behalf of "David Lazarus." There may be other laws pertaining to creditor behavior, but the 4th amendment ain't one of them.

Huh? The point is that the banks don't fall under the 4th amendment. They do what they want, when they want. The police and IRS have rules, the banks make up their own.

I would not think that.

And banks/creditors do have rules. I guess I wouldn't automatically get too upset about a pushy creditor. They lent someone money and that person isn't paying it back. You would probably get a little pushy if someone wasn't paying you back.

Of course not since that pertains to the US govt engaging in unreasonable searches and seizures.

Not that what Cap One is doing isn't creepy enough. I say they're trespassing private property and harrassing. I'm sure there's laws against that. They can sue if the guy owes money...then they can seize his property if he doesn't pay up.

Well thats bullshit if true and I believe what you say. If I get a credit card I supply credit info, i assume they still get account numbers, and if its through my bank…my wires visa is, if I don't pay the bill they should go get their money. Sue my ass. You credit card a bunch and default, if the cash is there they should get it or freeze it and let you sue to get it back.
I have 3 credit cards and Ive never missed payment in full every month. So I don't know what they do in reality.

They did in Greece. It's called "bail in" and steals money from private citizens for the good of the government. There have been new laws written in Europe and the US that allows the same thing to happen.
