SCOTUS: Police must have a warrant to look at your cell phone

The supreme court has unanimously ruled that the police must have a warrant to search the cell phone of someone who is arrested.

The supreme court also ruled that warrantless searches of a cell phone are generally not permitted. The cops can still grab your cell phone to keep you from deleting something for example, they just cant unlock it and look through it without a warrant.

Explaining why warrantless searches aren't allowed (usually to ensure the safety of the cop):

Law enforcement officers remain free to examine the physical aspects of a phone to ensure that it will not be used as a weapon--say, to determine whether there is a razor blade hidden between the phone and its case. Once an officer has secured a phone and eliminated any potential physical threats, however, data on the phone can endanger no one."

Apparently the court has carved out a minor exception for those far-fetched "24" type of scenarios that people sometimes argue about, like if they catch someone who they think planted a bomb that is about to go off.

That obviously won't apply to 99.9999% of cases.

About ****ing time that the SCOTUS has sided with people instead of police when it comes to the expansion of police powers.

It's a victory but we still need congress to limit the police state creep that has happened as a result of the drug war.

If they don't obey it, then anything they get from it would be thrown out in court.

Considering the rubber-stamping that most criminal judges do for search warrant requests from police though, it doesn't change much. It just means that they will have to wait a little longer to search the phone.

This really doesn't bother me. We've been assuming warrants were needed for years and advising our police to get them.

The really nice thing about this opinion is that they didn't buy into the Defendant's argument that we needed to start having magistrates narrowly delineate exactly how the phone will be searched which is pretty much totally unworkable.
