Interesting vote coming up on this one. For the Missourians, where do you stand on this one? You can read about it here: http://www.nytimes.com/2014/08/03/us...tion.html?_r=0

HSUS makes PETA look sane, which tells you how wacked that organization is. Anybody who enjoys eating meat at all should hate that organization with passion.

For it. I don't vote or live in Mo. but I own a small farm in Mo. I think it is pre-emptive and largely symbolic but all of the folks that are real Mo. farmers that I trust, are for it, so good enough for me.

Seems to broad and how will that effect local laws? Does it mean after it passes I can start having cows and chickens in my backyard, maybe some pigs?

Q: Who benefits from the Farming Rights Amendment?

A: Small farmers, hobby farmers, family farmers, organic farmers, and all farmers benefit from the Farming Rights Amendment. The Farming Rights Amendment will protect all farmers equally and Family farms will especially benefit as they do not have the resources to relocate or fight off well-funded anti-agriculture groups that have used the initiative petition process in many states to target agriculture.

Q: Why do we need the Farming Rights Amendment in the Missouri state constitution?

A: Agriculture is Missouri’s largest industry, both the lifeblood of rural Missouri and a major employer in urban Missouri. Some extremist groups have targeted agriculture in recent years and now farmers are supporting the Farming Rights Amendment to provide long-lasting legal protections for their way of life and for the economic base of our state.

Q: Does this amendment restrict local control of agriculture?

A: The Farming Rights Amendment does not change or supersede any local ordinances or jurisdiction that is currently in place. The Amendment creates constitutional protection for farmers and ranchers and will work side by side with local jurisdiction to protect their rights.

Q: Does this amendment give farmers and ranchers a “blank check” to do whatever they want?

A: Every right is subject to reasonable restriction. Just as we can’t shout “fire” in a crowded building, farmers will not have a blank check under the Farming Rights Amendment. State and federal regulations that are in place will not be superseded by the Farming Rights Amendment.

Q: This amendment will last forever. Do we really need that?

A: Yes. We must protect our food supply and our agriculture industry. This is an issue that needs to be addressed now for the future.

Q: Does the Missouri Farming Rights Amendment effect foreign ownership of Missouri farm land?

A: No, limitations that are currently in place for corporate and foreign ownership of Missouri farmland have already been found constitutional in federal courts. Corporate ownership of Missouri farmland is geographically restricted and foreign ownership is set at a 1% cap of Missouri agricultural land. The Missouri Farming Rights Amendment will not change any of this.

Will this amendment interfere with a county or city government’s ability to regulate agricultural activity?

No. The language of the Right to Farm amendment specifically leaves the powers of local governments in place under Article 6 of the Missouri Constitution. If the Right the Farm amendment passes local governments will have all the same powers.

Thanks.

After further reading this it appears this would override the already existing nuisance laws. So basically big farms could farm without having to worry about the smell and shit coming from their farms. Also there is no local protection only for charter counties.

Quote:
Finally, although the official ballot language voters will see when they go to the polls next month gives no indication of this, the Fair Ballot Language that voters won’t see when they go to the polls on Aug. 5 states, “A ‘yes’ vote will amend the Missouri Constitution...subject to any power given to local government under Article VI of the Missouri Constitution.“ Instead, the voters will see official ballot language that reveals nothing about the impact of Amendment One on the ability of local government to regulate CAFOs.
While the official ballot language won’t refer to local government protections, the letter from Shoemyer and Harris warns, “The clause to be added to our constitution by Amendment One makes specific reference to Article VI, which contains Missouri constitutional provisions relating to ‘local government’...[However,] only charter counties are granted additional constitutional authority to adopt their own ordinances and rules, and out of Missouri’s 114 counties only four have achieved charter status [and neither Scotland nor Linn Counties are charter counties]. If Constitutional Amendment One passes, you will be left without any ability to provide reasonable health and welfare safeguards for neighbors living in the rural areas of your county.”
On three separate occasions in as many days last week, the LCL contacted the Missouri Attorney General’s Office for confirmation that Article VI of the Missouri Constitution doesn’t include local government protections for unchartered counties such as Linn. We explained why we were calling in detail and the receptionist advised we would receive a call back. None of our calls were returned.

Thats directly from HSUS.
