Lewisville ISD: Former Miss Texas contestant faces possible jail time

A first-year Hebron High School teacher and former Miss Texas contestant faces up to 20 years in jail after an 18-year-old student told police he had sex with the 25-year-old woman several times at her apartment in Austin Ranch.

Amy McElhenney, who taught Spanish and was a cross-country coach at the school, is charged with having an improper relationship with a student, a second-degree felony. She was arrested on May 25, the last day of school, posted $5,000 bail and was released.

Ms. McElhenney could not be reached for comment. The student's identity was not released.

According to an arrest warrant affidavit, another student sent an anonymous note last month to Hebron's resource police officer that indicated Ms. McElhenney's cellphone contained "intimate" text messages to and from the 18-year-old.

When police interviewed Ms. McElhenney at the school, she allowed them to view the text messages.

"Messages that were on there led us to believe there was a little bit more going on between the teacher and this student," said Carrollton police Sgt. David Sponhour.

In an affidavit, a Carrollton police officer said the messages "constitute a flirtatious and endearing relationship" between Ms. McElhenney and the student.

While Ms. McElhenney denied having a physical or sexual relationship with the teen, she told police she felt their relationship was inappropriate, police said.

When interviewed at home, however, the student gave police a written statement in which he said he and Ms. McElhenney had sex on "numerous occasions" at her apartment. He told police their alleged relationship began in February.

Ms. McElhenney was charged under a law that outlaws sexual relationships between educators and students even if the sex is consensual and the student is of legal age. In Texas, the age of consent is 17.

Proponents of the law have said it sends the message that even older teenagers should not be considered capable of consenting to sex with a teacher, especially since educators have power over their students.

Others, however, have said that while the law's intent may be good, it should contain different provisions for different ages and distinguish between students who do and don't consent.

The law took effect Sept. 1, 2003. Between then and the end of 2005, only five Texas teachers were convicted and sent to prison under the law. Three Garland school district teachers were arrested under the law in 2005 and accused of having sexual relationships with students. One of those teachers also was charged with two counts of indecency with a child because the student was underage. The Lewisville school district placed Ms. McElhenney on paid administrative leave May 11. In March she turned in a resignation form that went into effect May 25. Officials said she indicated she was not returning to Hebron because she was taking a teaching position in another district, though they were unclear on what district that is.

School officials said they alerted the state certification board of the investigation and her arrest.

Ms. McElhenney was scheduled to teach a Spanish course at a summer camp program in Corsicana, where she was hired as a contract employee after being selected to teach the course for 7- to 12-year-olds by the Navarro Council of the Arts.

"In light of the information, we'll either find another instructor or cancel the program," said Connie Standridge, Corsicana's city manager.

According to the Miss Texas Web site, Ms. McElhenney competed in the scholarship pageant in 2002 as Miss Bexar County when she was a Spanish and education major at the University of Texas at Austin.

I read that the percentage of this is much higher for teachers than for RCC priests. That it's at least 10% as high as 13% and they just relocate them to another district with no downgrade. They call it "passing the trash."

The American Medical Association found in 1986 that one in four girls, and one in eight boys, are sexually abused in or out of school before the age of 18. Two years later, a study included in The Handbook on Sexual Abuse of Children, reported that one in four girls, and one in six boys, is sexually abused by age 18.[xxix] It was reported in 1991 that 17.7 percent of males who graduated from high school, and 82.2 percent of females, reported sexual harassment by faculty or staff during their years in school. Indeed, it shows that family members are the most likely to sexually molest a child. It also shows that the incidence of the sexual abuse of a minor is slightly higher among the Protestant clergy than among the Catholic clergy, and that it is significantly higher among public school teachers than among ministers and priests.

Yeah, I'm not really buying it. Every school district in Arkansas (this is Arkansas mind you) does extensive background checks on a person before they're hired. The authors also make it sound like there is some kind of conspiracy at work with their language "moving molesting teachers" which implies that someone is doing the moving. Who would that be, if the superintendents aren't notifying each other of the problem? Appears to be written with an agenda in mind of bashing public schools.

All that being said, there are a disturbing number of these cases occurring these days.

He has a comment earlier about googling his ass off and finding nothing about the story. I believe his original post mentioned hearing about the story, but not finding anything on it.

You could always check the original research.
But I also read a news report about 4 years ago, on a big internet sting on child porn, and many of the people arrested worked closely with children...people you'd tend to trust, including counselors, ministers, rabbis and teachers etc.

I knew that you, in particular, were going to say that when I posted it. If you read it however there is references throughout to other research. It was compiled to put their case into perspective. Check out the references including the AMA if you're as objective and unbiased as you claim. That may be more credible than innuendo.

Also, according to the legal records on the RCC scandals those claim that it's 2% of priests. However according to a survey conducted by the RCC to dig deeper they claim it's 4%. Link (http://www.americancatholic.org/News/ClergySexAbuse/) Doesn't sound biased to me.

What sounds more biased is the stance of anti-religionists and or anti-Catholics. Catholic bashing and pedopile priests (http://www.worldnetdaily.com/news/article.asp?ARTICLE_ID=26955) Article was writtten by a Jewish journalist.

BTW, RCC cover up was due to gays in the hiearchy too. Also Pope John Paul refused to believe such charges as communists in Poland use to use allegations of priests being gay to discredit the church.

Regardless, trying to put perspective on it is a fair defense. But let's not forget that others also have an axe to grind against religion or the RCC and refuse to see any of the same acts elsewhere because it discredits their prejudice.

It's not the fact that there's a high incidence of sexual impropriety among school teachers that I doubt. I just doubt that it's common practice for public school administrators to knowingly shuffle such teachers from district to district, putting them back into contact with kids when they know something inappropriate has occurred. It's clear that the author is trying to draw a parallel between the practices of the Catholic church (shuffling accused priests from one parrish to another) and those of public school administrators.

Please, I'd nail about 4 or 5 of the teachers in my high school, an I know one of the guy teachers was banging at least one of his female students every year. Its the way it is, just people want to brag now.

The story is they are handing down a felony and prison sentence for this now even if both are of legal age. Texas is becoming one ****ed up place.

I don't have a problem with this one at all. Hell I'm 48 and my GF is 35. The thing that gets me is all the other ones down in Florida and therebouts banging 13 yr olds. And their drop dead georgeous for the most part. It's not like they should have a problem getting shagged by guys their own age. :shake:

17 is legal in Texas (boy I really blew it, huh?).

The issue is that there is a state law that prohibits teachers from screwing students.
