Today has been one of my most shittiest days.

I just found out by mail that I lost my civil case (in which I was the Plaintiff). So I wasted a bunch of money on court/serving fees.

What happened is my car was struck from behind while stopped on the exit ramp of a freeway and the guy who hit claimed to be hit by someone else. He did have slight rear end damage however, comparing his rear end damage to his front end damage and my rear end damage, it was clear he was not traveling at a safe rate of speed either way.

Anyways, during the court case the judge gives us each 2 minutes to explain our story and then he puts the case under submission, meaning he was going to look at all the evidence both sides provided on his own and determine who wins. So I spent endless hours rehearsing what I was going to say/argue and I don't even get to do it in court. The defendant claimed he was traveling 5-10 miles per hour when he hit me, but the $10,000 estimate to my rear end (of my car pervs) says otherwise. I told the judge that too as we were leaving.

Also, in the evidence the defendant provided, he had a "key" witness that gave a statement to his insurance company saying "I think there was a hit and run driver," "I'm not exactly sure what I saw," and "You really can't count on what I am saying, it happened so fast."

So now I am stuck driving my 1989 Toyota Celica ST. Oh, then I'm checking that car out and guess what? The front tires are bald and on one of them, the radial threads are sticking out. So now I have the spare tire on it and I'm getting 2 new tires tommorow and I don't have any money in my bank account.

HOORAY FOR CREDIT CARD DEBT!

Why would it matter if his car was struck? Wouldn't he still be responsible for the damage his car did to yours and then it would be up to him to sue the driver of the other car?

Exactly. All along everybody has been telling me I have a 99.9% Chance of winning. Its just my luck that I lost. That ****ing judge gave us 2 minutes and left what a dick.

In Kansas, you can appeal it to District Court within 10 days of the judgment, and everything is tried all over again.

You should check to see if California has that and spend $1k on an atty to line up your stuff and get your $.

Careful, though, because on appeal if the defendant wins, they can probably get their atty's fees added and you can't.

Seriously, you needed just a mediocre attorney to cross-x that lamo witness and get your docs in order.

Yeah, so I only had liability insurance, so my insurance company won't cover. However, for the insurance I pay for, there is a clause if I am in a collision caused by a hit and run driver, then I am covered. So I call my insurance company and they say that I need to have the drivers information or the license plate number of the hit and run vehicle. How much bullshit is that?

Yeah, I had a judge tell me something pretty stupid last week too.

Your judge may have been great, but they don't always put the cream of the legal acumen on the small claims docket.

I had a new engine put into this vehicle before the accident and I am still paying off on the engine of the car I haven't been able to use since July 15, 2006.

No Fault ? To save your rates DO NOT make a claim. Thats how to keep your rates down....

They should be able to tell you what this claim will do to your rates.

An SC2 in excellent condition with only 80K miles around here would be worth $2150.

I'm pretty sure he was expecting book value, and possibly more since he had just replaced the engine. He was talking the other night about having $4-5K to spend on another vehicle. I'm not sure how he arrived that number, but I don't think he was expecting a $10k settlement.
