She's only ordered to spend 23 days total so she's got 18 days left.

What's ridiculous is that Michelle Rodriguez only had to spend 2 HOURS in jail when she got her DUI though the sentence was for 60 DAYS.

Come on, Dude. The Sherrif's department set her free, not a lawyer or judge. This sh*t happens all the time out here. You'd never hear about it because it's extremely rare that it's some as depised as Paris Hilton, but it happens all the time.

The AP, Fox, CNN, and MSNBC are all reporting it. The 45 days was the original sentence. She was able to get out in 23 days if she showed good behavior.

Another of her attorneys, Steve Levine, said, "The sheriff has determined that because of her medical situation, this (jail) is a dangerous place for her."

"The court's role here is to let the Sheriff's Department run the jail," he said.

A former district attorney, Robert Philibosian, also represented Hilton. He said that the law supports the sheriff in making an independent decision on her custodial situation.

The judge interrupted several times to say that he had received a call last Wednesday from an undersheriff informing him that Hilton had a medical condition and that he would submit papers to the judge to consider. He said the papers never arrived.

Every few minutes, the judge would interrupt proceedings and state the time on the clock and note that the papers still had not arrived.

He also noted that he had heard that a private psychiatrist visited Hilton in jail and he wondered if that person played a role in deciding her medical needs.

three opinions...

while the sherriff generally is responsible for running jails, they still have to comply with orders from a judge... (think overcrowding orders)

as far as her attorneys' opinions, keep in mind that they're being paid by paris (or someone else in her family) to present the most favorable impression of paris that they can...

that includes interpreting the law in such a way that it appears to support their client's position...

iow, you shouldn't always believe what attorneys say about their client...

in fact, you shouldn't believe what attorneys say in general... (duh!)

Bullsh*t. In a prior post, I mentioned that Michelle Rodriguez spent 4 HOURS for her DUI conviction in the West Hollywood jail, not the 60 days required by the judge. IT HAPPENS ALL THE TIME IN WEST HOLLYWOOD.

I could care less who the person is, but I think that 45 days in jail for getting caught driving with a suspended license is ridiculous, no matter what city, county or state is involved. Jail time like that should be for violent offenders, not suspended drivers.

I honestly cant get over her & her families UBER DRAMA in the courtroom, i hate them all now. She was bawling & squealing like she had just been sentenced to 10 years in the general population at Attica, not 23 or 45 days or whatever the hell it is, in a private cell at county.

Dane, for the life of me i cant understand your constant defense of this girl. Why is she being treated unfairly??? All judges are different & allowed a certain amount of discretion in sentencing in most cases. She got a judge who felt strongly about her offenses, she'd been put on probation, violated that probation, was late for court (no matter the excuse) & drove the wrong way down a street with her lights off at night.

Thats pretty serious stuff & you cant compare her case to another...different laws in different states, judges who interpret laws differently etc. Its 45 days, thats not some brutal sentence. The girl needs to learn a lesson & chillin by her pool drinking Mai-Tai's with all of her pals coming over is NOT going to teach her squat.

I'd bet anything there are plenty of people who got her sentence & worse for what she did.

The way I see it, the Hilton family isn't doing anything illegal. They've hired lawyers and have tried to get to the court to change it's decision. While people who aren't familiar with the trial system may find that repulsive, they're doing everything they can do within the legal framework to get her sentence reduced.

While I agree with many people who've said that this experience "will be good for her" and I agree that it's not "unfair". But considering some of the other examples (Jared Allen, Michelle Rodriguez, Scott Freakin' Wieland!), it's certainly more excessive than would it *could* have been. I heard some LA lawyer on TV the other night say that there is no one in LA County doing 45 days on driving while suspended who has no priors, except Paris Hilton.

From that perspective I can see her point that because of the media attention she might have gotten a much worse outcome than the average Jane Doe would have. That's what media attention would predictably do though. If you are well liked, you get leniency out there. If it was Jennifer Aniston I doubt she would be doing any jail time. But since everyone hates Paris Hilton and is enjoying seeing her suffer, the media pressure had the opposite effect this time.

But still, she knew what she was doing, and that if she were caught she would be throwing herself to the mercy of the justice system. I'm sure she thought she was Teflon but it turns out she was wrong. Nobody, obviously, is feeling sorry for her.

It would where I grew up. I once saw a man show up for his sentencing for a DUI probably drunk and cursing at the judge. Needless to say the judge was rather through in his decision.
