Is it like the tv shows where you just say "I plead the fifth" or do you have to preface it ?

Also, my understanding of the fifth amendment might be a little hazy since college government. Is it only for self incrimination or can it be used to not incriminate someone else ?

Depending on where you live, you may be able to avoid incriminating your spouse, but that's separate from the 5th Am.

The IRS is part of the Executive Branch. The IRS is under the Department of Treasury, overseen by the Secretary of the Treasury, a member of the President's cabinet.

That's no longer sufficient. You must now 'speak' in order to assert your right to remain silent. You can actually buy cards to give to the police now, if you wish.

Apparently, it's the only way to get the Supreme Court to hear you. the ruling is absolutely crucial for the average American to understand because it applies to pre-arrest exchanges with law enforcement. In other words, the next time that you have a casual conversation with a police officer, proceed with caution, because anything you don't say may be used against you in court.

The IRS is not made up of political appointees brought in by the incoming president. Until just last year, the director was still someone who started during Bush's term.

I'm actually referring to the fact that you don't have to testify on your own behalf in a criminal proceeding.


I could be wrong but that's how I always understood "the 5th."

You can still decline to take the stand in a criminal case.


You can also refuse to testify in a civil case. However, that's not a 100% situation any more, because the courts have decided that you can be compelled to speak, and be put in legal jeopardy if you won't, by offering you immunity.

I was threatened with being handcuffed and taken to a police station for questioning when I pleaded the Fifth. Talk to some lawyers after and the advice was all different—and that was with the full story told.

I did finally talk, and two witnesses also appeared. So they left me alone.
