A concussion is defined as a TBI that causes temporary loss of function. There is no doubt that Smith suffered a concussion. The NFL protocol must screen only for concussions that result in persistent symptoms of a certain magnitude. Seems pretty hypocritical for the NFL to allow any player to play during a game where they have suffered a concussion of any magnitude.
