Either way it is bullshit. If you are an age of legal consent you are an age of legal consent. That doesn't change just because someone is your teacher or mentor.

That doesn't mean the person shouldn't be fired from their position but there should be zero charges.

Under normal circumstances, sure. But assuming the laws are equal between men and women (which they aren't), this sounds like she could be charged with rape.

17 is legal in Texas only if you're 19. If you're over 19 then age of consent is 18.

Also, Texas has a law that educators can't have a relationship with a student in their same district regardless of whether they are of age or not. If he was in a different district and 18, then it would have been legal.
