It's perfectly legal, and more common than you might realize, for teams to exchange ideas about potential deals in the days, weeks and even months leading up to the official start of the trading period. The only thing they can't do is finalize the paperwork. That means neither team can discuss it publicly. Smith, his agent can do whatever they feel....

It would be up to the Chiefs to file a tampering grievance. Since they were actively talking with teams about trading him they probably gave teams permission to speak with him about an extension because the reason Smith chose the Redskins was that the Browns weren't willing to give him a long term deal.
