We check the game before we ship & put the warranty sticker. Please go ahead and send the game back to the address below with a note inside which has your ebay user id, the auction number and the reason for the return. Once we receive the item we will take care of the exchange/return. Please make sure warranty sticker is intact. You can ship us by usps first class 6oz.

TAMPER/SAFETY SEAL(S) ARE PLACED ON THE ITEM ITSELF, IF THE TAMPER SEAL(S) ON THIS ITEM! NO EXCEPTIONS M IS REMOVED OR BROKEN, ALL SALES WILL BE FINAL.

Talk about a complete contradiction considering I removed the little "white sticker" (how I could have known it was a "tamper seal" is beyond me) because I felt the sticker was causing the problem due to other past experiences with DVDs. I told him in my previous email that the sticker was removed. A reasonable reason as well.

After really looking the disk over there is a crack right in the center of it that is probably the problem and he is unwilling to provide any care. Great customer service there.

If you used paypal - file a claim. I've had to do this a few times.

Why did you name your son Rock Band, and how did you get him off of eBay?

Overall, I would disagree. Up until now, I have saved a ton of money on Ebay for Xbox and Wii games. This was a first. Unfortunately, I may back off of it for while now thanks to this idiot.

How did you pay for it?

If Paypal, file a Item Not As Described and say it is broken, and described as working.

If not Paypal, then I hope you used a credit card. File a chargeback.

If bank account, you are ****ed, stop using it for ebay!

Got the temp copy today to try and it worked like a charm. At least I know it IS the disk and not my console now. Thanks Lzen.

Looks like I will just have to pay 20 bucks to EA to get a replacment disk. So much for the savings. Dangit. Went from saving 25 bucks to saving nada.

Used my AMEX through paypal. This guys return policy is going to be iron clad though, whether I like it or not because it is passed 7 days since I received it.

AMEX would remove the charge ASAP but I fear after the investigation they would just put it back on there in 8 weeks.

Generally Paypal sides on buyers when you file INAD (which it is since it's broken). Last ditch effort is to file a chargeback with AMEX, but try Paypal first. If you do a chargeback, PP will likely close your account.

Yep.. I've have to file a couple of claims. Make sure you don't use any language that isn't necessary when doing so. Explain the problem as best you can and attach any emails you got from the seller.
I haven't lost a claim yet.

There are tens of thousands of sellers on eBay. It's not the fault of "eBay" that this occurred. It's probably not even the seller's "fault".

This could have happened on any e-commerce site, even Amazon.

I'm sorry to hear about your troubles but placing the blame on eBay is misdirected.
