I assume you mean "prosecuted" and at some point, they might be.

They have been before. People that have leaked information to them have been fined and even jailed.

Make no mistake about it though, TMZ operates in a way wholly unlike any legitimate business. They make no bones about being ethical and have lawyers at the ready to defend them when people cry foul.

You're right, not sure where I came up with persecuted, but so be it, but a company with means, I have a hard time believing they couldn't find out. They have too much on the line to not know.
