If you are both on the lease you are liable for the full portion together. SO, even if you pay 1/2, if the Ex doesn't pay hers, the landlord can still come after you for the other half. In the lease you agreed to pay X amount per month, not 1/2 of X amount.

Unless you are talking about a huge lease or many months left, your best option is to both agree to move out of the house and workout a settlement with the landlord regarding the remaining rent.

Since you're a student you may qualify. If not, find an attorney as others have mentioned. Don't waste your time talking to your ex or your landlord until you know your rights.

You are on the hook for the full amount unless that lease is really stupid. Don't bother just paying your half, you're on the hook for the whole. If the ex doesn't pay her half and it's three months before you find out that's a three month late-pay on your credit.

Getting your landlord to rework the rental agreement to be only in her name is probably not going to happen. Unless the landlord gets an extension or something what's in it for her? All she's doing is losing one person to sue for unpaid rent.

One solution is to move back in. F**k her, it's your place too. If she doesn't like it SHE can move out. The down side to this "brilliant" plan is that psycho whore could just file a restraining order on you and then you have issues way past bad credit.

So, in conclusion, get a lawyer. He's going to know what laws your state/county/city have that pertain to your situation. There may be some outs because she's kicked you out, etc.

And for those of you saying "this is why you don't move in with a woman" I say this is EXACTLY why you DO. You don't find out some of this type of crap until you're around the bitch 24x7.

I'm afraid she could do that. I checked into it and it says I have to be a threat to physically harm her or actually harm her and no way in hell would I do that.

Yeah. Unless you have about 40 witnesses with video cameras this is how that will go for you:

If you have a video camera I would recommend having it roll any time you're with her. That still won't preclude the "he wasn't taping when he did THIS one" bit, but it should keep her from becoming abusive (or if you're *really* lucky she will do something dumb on camera). Get your s**t out, take pictures of the place after you have your stuff out, and get a hotel room.

Yeah, that "half" rent plan bothers me. That seems like an attempt for the landlord to just minimize her losses until they inevitably break the lease and get sued for the full amount anyway.

The second she isn't getting all of her money she's going after whoever she thinks she can get the money from, and that is going to be whoever has been paying FIRST. No point in trying to get money out of someone who doesn't care when there's someone who does.

Good idea. I'll be talking to a lawyer tomorrow about all this and I guess as long as it doesn't cost more then just paying the 275x7 rent that is left on my part I'll probably have to get one.

Don't expect the landlord to do anything for you. It's not in her best interest to help you out. It's best for her to leave you on the hook for when psycho bitch goes, well, psycho and quits paying, flat disappears, etc. Landlord won't do anything for you that she isn't legally required to and you demand.

Hey, any chance your ex has been vicious enough that you can call the cops and tell them you're afraid for your safety? Might get her out of the house for a few nights. She's from there, she'll find a friend to crash with.
