That is true. Student could have gotten ahold of the phone and sent the pics. Hypothetically I havw witnessed similar with the pe4son deleting the sent message. Now if they are able to pull text back and forth, won't help her case. She wil never teach again and will probably soon be single. But it seems the kids were of age, so I don't think she should get any predatory crimes against her.

As far as the law is concerned, yes. It is illegal (in most states anyway) for a teacher to date a student, regardless if the student is of consenting age.

Yep, it's very possible that her phone was lying out on her desk, kid got it, looked through it.
