You could get the death penalty for just Attempting, authorizing or advising the killing of any officer, juror or witness in cases involving a continuing criminal enterprise, regardless of wether such killing actually occurs.

You don't even have to have actually killed someone and still be eligable for the death penalty, I posted that before this one.

I realize the difference now, that being, if murder is committed as the ones on the list it is federal other murders are state.

I just admitted I was wrong about that, after doing some searching on the net, I finally figured it out.
