There is already hate crime legislation

1990 Bush Sr. Signed the Hate Crimes Statistics Act which requires the US AG to collect hate crimes statistics

1994 Congress passed the Hate Crimes Sentencing Enhancement Act which allows federal judges to enhance a sentence by no less than three offense levels. protected classes are Race, Color, Religion, National Origin, Ethnicity, Gender, Disability or Sexual Orientation.

All states have various formes of this law some that date back to as early as the lates 70's and early 80's but vary greatly in who are the protected classes and what the punishment is
