Legal Question
 
Any legal guys on here

I have this idiotic friend that let his girlfriend use his unemployment debit card about a month ago and she took over a thousand dollars out. Don't ask me how or why it took the jack ass this long to notice it, but it did. Is there anything he can do about it? Call the police etc.... You know she's just going to say he told her she could? Thanks in advance.

Nope. It's pretty difficult to prove fraud after it's established that you gave the card to the individual.

Wow, not sure how to take that. I've been laid off for almost a year and I send out 5, 10 resumes a week and have only gotten three interviews. I know he's trying, but what the hell does that have anything to do with it.

Actually I think he had her setup his unemployment and have the card sent to her. Like I said "an idiot".

That is fraud, as long as he's willing to fraudulently say he didn't authorize it. Then she's looking at jail time, and the state MAY give him the money back. It's gonna take a little fraud from his end though, since he authorized it.

Unfortunately, if you're friend is an honest and forthright person, he's ****ed.

I do a little lawyerin on the side. My legal advise to him would be "Your ****ed"

He should at least tell her she owes him a BJ for every dollar she stole.

I'm not sure if he would do that or not. Wouldn't that just be he said, she said if he did the interview with the unemployment office and had the card sent to her. This is just ****ed up beyond words, why in the hell would you have your card sent to someone else? Actually I think he was just being lazy and had her take care of it. Stupid, Stupid, Stupid

Yeah, I wouldn't help him out if I was you. I wouldn't really give him any advice at all on how to **** her, or the state over. He made a mistake, and it should be him to pay the price. Just my two cents.

It seems a little silly for the state to send an unemployed person a debit card.
