Last time I went in to get a new one at the SS office they told me there's a lifetime limit of 3 times which copies can be made. :spock:

I don't know about the legality ... there may very well be a problem there.
If it had been my SS Card, though, that merchant had better be praying to God that I didn't suffer any problems with my credit either now or in the future. I would be on his dumb ass like Romeo on an egg roll. That was a very stupid move on his part. FAX |

It is legal, in that it is not a crime.
However, that business could be liable if you suffer damages due to this act, and could be sued. May or may not be able to sue the owner or person responsible individually as well as the business. You have to incur actual damage, you cant just walk into court and say "I'm afraid my identity may be stolen", they'll tell you to come back when something actually happens. Until then, you could still reasonably make the argument that you now need to pay for a fraud alert and credit monitoring for years, and you could probably sue for the cost and time of doing that. |
So today went and retrieved it. Guy acted like he did me a favor. I bit my tongue, because he meant no harm, then I proceeded to explain to the older fellow just what can be done with having just that bit of information. He still didn't get it. Then I spent an hour on the phone with the SSA, next the police department to file a informational report, next the federal trade commision and next all 3 credit bureaus.
For the record, I know it shouldn't have been in my wallet, but I pulled it out of the lockbox when I was job hunting and forgot about it. The police stated that their primary concern was an illegal using it for employment. A stupid mistake on my part that has me very much on edge. |
