Attorney question
So, as most of you know I got engaged this year. Well it isn't working out anymore and I will be moving back to where I was before.We moved into a house together in July with both of our names on the lease contract. Now, here's the question. She just sent me a message telling me to move my shit and leave or she would move it for me. Do I have to pay my half of the rent even though she kicked me out? I was just going to send the landlord my half when I moved out after the semester so I didn't get into trouble legally.
The landlord told me I was still liable to pay my half even though she kicked me out. Is that true? |

Your name is on the lease, you are liable.
But, if you really want to be a dick and she kicked you out stop paying. She'll pay it or you'll both be evicted. If you've already been booted out, who cares? |
Your name is on the lease, you are a tenant and have a right to be in the house and also have an obligation to pay rent. She can't kick you out.
If she wants you out she needs to agree to pay your portion of the rent. This agreement needs to be confirmed with the Landlord as well and your name removed from the lease. Oh yeah, grab the e-ring, that's yours too. That's a quick, non-legalize answer. |
I think I would have her arrested when she "moved" your stuff out. If your name is on the lease, it's half yours.

YES.....She doesn't have the authority to absolve you of any financial responsibility to the contracting agent. The contracting agent only has that authority.
As long as you meet that responsibility(pay the rent), you can legally stay. She sounds pissed and you probably don't want to, you need "official" legal council. |
I am not an attorney but I am 99% sure you are still responsible for any lease you signed, even if you decide to move out (for whatever reason). My advice to you is to pay the rent and see if you can't negotiate something with the landlord.
Oh, and whatever you do, stay the heck away from your ex. Even if you pay another six months rent on a place you no longer live in you are miles ahead of any divorce settlement you would have had in the future. |

Sit down at a table and settle this like adults. You should both have a few drinks during the discussion to help you both relax and put things on an even keel. I'd suggest having lots of firearms around, too, so that both parties treat each other with the proper respect.
