Lawrence Taylor to plead guilty <cite class="source">By Jane McManus ESPNNewYork.com Archive </cite> Lawrence Taylor is expected to plead guilty to two misdemeanor charges in court Thursday, stemming from a May 6 arrest for felony statutory rape. The recommended sentence is 6 years probation. He could receive up to 2 years in jail, although his attorney, Arthur Aidala, said he believes that he will not get jail time. Taylor plans to plead guilty to one count of soliciting a prostitute, and a second count of sexual misconduct in having sex with a woman without consent. Since the victim in the case was 16 years old, she was not old enough to give consent. Photo gallery In New York, ignorance of a person's age is not a defense against statutory rape. The age of consent in New York is 17. Taylor also faces a sexual offender hearing, which most likely will occur in a few months. This hearing is to determine if he must register as a sex offender. On May 6, Taylor was arrested early in the morning at a Holiday Inn in Montebello, N.Y. Police said they were led to his hotel room by a 16-year-old runaway who had allegedly been forced into prostitution by Rasheed Davis. Davis pled not guilty to charges of sex trafficking, while Taylor pleaded not guilty to charges of third-degree rape, patronizing a prostitute and endangering the welfare of a child. The rape charge carried a maximum of four years in jail. That day in May, Ramapo town supervisor Christopher St. Lawrence alleged that Taylor paid her $300 for sex. Taylor posted the $75,000 bail that day. Aidala asked Rockland County Judge, William Kelly to dismiss the charges on Dec. 8, on the grounds that Taylor's fourth amendment rights were violated when the hotel room was searched upon his arrest. Physical evidence, including condoms, was recovered in the search. Kelly denied the request. Taylor led the Giants to two Super Bowl titles, in 1987 and 1991. He was inducted into the Pro Football Hall of Fame in 1999. Rockland County prosecutor Arthur Ferraro said on Dec. 8 that Taylor had been offered a plea deal which included 6 months jail and 10 years probation if he pled guilty to a felony, but he also would have needed to register as a sex offender. Stupid question here, but I really don't know. The article says the age of consent in New York is 17. Does that mean a 17 year-old can boink whoever she wants? For some reason I thought it was always illegal to dance the ancestral dance with someone under 18. Like, they're not a legal adult until they're 18. Is that not right? |

I don't know if I'd say that he "skated". It sounds like the charges are appropriate. He didn't rape the girl. He picked up a telephone and requested a prostitute, and he was correctly charged with soliciting a prostitute. Since the girl turned out to be 16, he was also appropriately charged with having sex with a woman without her consent (since she can't give consent).
If the charges had been dropped, I'd agree that he skated. But to convict him of a felony and throw him in jail would have been pretty harsh. |

S 130.25 Rape in the third degree.
A person is guilty of rape in the third degree when: 1. He or she engages in sexual intercourse with another person who is incapable of consent by reason of some factor other than being less than seventeen years old; 2. Being twenty-one years old or more, he or she engages in sexual intercourse with another person less than seventeen years old; or 3. He or she engages in sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent. Rape in the third degree is a class E felony. Looks like Taylor falls in category (2). Why not go for the class E felony? |

In Nevada the age of consent is 16. Legally, anyone other than a teacher can have sex with a 16 year old. A law was created a few years ago because there had been some problems with teachers.
