Yes, you would definitely think.
Which is why Brady's lawyers are going to paint this as a massively important issue implicating all arbitrations around the country, and therefore deserving of SCOTUS review.
And trying to thread that needle is why Brady has hired Ted Olson, who is a super-heavyweight lawyer with massive SCOTUS experience.
Not that that is likely to be enough, mind you. He's pretty much doomed at this point, but instead of a 0.001% chance, it will be a 0.01% chance, and for that marginal increase Olson will probably be paid a million bucks.
