He's right.
There are more ways you can kill a person in a motor vehicle accident and NOT go to jail than there are ways you can kill a person and end up going to jail.
Again - criminal negligence is a much higher bar than y'all are discussing. Even being on the phone is almost certainly not going to qualify. Texting with one hand, eating a sandwich with the other and driving 80 mph with your knees might get you there.
But you're essentially saying that any negligence, even simple negligence, that ends in a death will mean jail time. That's simply not the case.
