There is no grandfathering on a landowners lateral encroaching from his property onto another property owners property and tieing into the neighbor's private property lateral. Unless a legal document is possessed that approved and signed by each party. That pertains to the original ownership and should show up as a red flag by the title company in a change of ownership.
