They’ll still need to prove he was driving. Assuming he didn’t send any other stupid texts and he and his friends kept their mouths shut, it will be hard to bury him.
I’ll bet they strike a plea deal for some misdemeanor just to mutually get past it (unless there is concrete evidence he was driving).

It actually makes him look less guilty as the driver. He most likely had to purchase the supplemental insurance that was only good on him being the driver. If he is offering to pay for the vehicle he may be indicating he wasn't driving(wink wink)... Long ways to go before we know the details.
