In the eyes of the NFL, he's a convicted criminal, DUI or not.
He's going to get 4 games under the NFL's criminal conduct policy, regardless of whether or not he was enrolled in the substance abuse program. It's very similar to what happened with Warfield - he wasn't suspended for the alcohol, he was suspended for the conviction.
One more screw-up and he misses a season.
