Less intoxicated ≠ Not intoxicated.
When the cop informed me 1) The guy reeked of it, 2) Was in posession, and 3) failed a blood test for MJ, and 4) blew just under "legally intoxicated" on a breathalyzer, I don't have any problem with them adding DUI and possession to the vehicular homicide charges.
Frankly, I wish they would have nailed the f**khead for murder.
If you've been drinking, smoking, whatever, stay the f*** away from behind the wheel. If you can't you're just showing a level of selfishness I can't fathom (my buzz is more important than the safety of others). Do whatever the hell you want, just not in a way that can affect others.
I can't believe how many people seem to be defending DUI/DWI.

I don't have a problem with an open container in public, be it alcohol or your hypothetical pot example. My
only problem is with idiots that get behind the wheel with one.
