You still have to pay the man his base salary for 2009 and 2010, plus any bonuses/incentives you worked into the contract.

And FWIW, the contract WAS front-loaded, where Cassel earns something like $41M over the first 3 years - essentially guaranteeing he'll be here for AT LEAST those 3 years.
