I don't know about the legality ... there may very well be a problem there.

If it had been my SS Card, though, that merchant had better be praying to God that I didn't suffer any problems with my credit either now or in the future. I would be on his dumb ass like Romeo on an egg roll. That was a very stupid move on his part.
