But you can profile without color : the car a person drives, their clothes, haircut, where they live, what music they listen to, who their parents are...hell, ANYTHING can be used for profiling purposes.

Yes, but in this instance you have a young black man driving a car 99% of the public cannot afford. He's in an area that is high crime and he's parked in a running car.
Cops would have arrested a person probably 99.999% of the time in that case regardless of what they looked like. In this instance they did not because of who he was. You can bet as they were approaching the car, ESPECIALLY WITH NEW TAGS and not yet registered, they were not planning on just checking on driver and leaving the scene.
If they were convinced he wasn't impaired then why didn't they allow him to drive home?
