Again - criminal negligence is a much higher bar than y'all are discussing. Even being on the phone is almost certainly not going to qualify. Texting with one hand, eating a sandwich with the other and driving 80 mph with your knees might get you there.
But you're essentially saying that any negligence, even simple negligence, that ends in a death will mean jail time. That's simply not the case.

then there is what was the distraction that led to the death. It’s different if your looking at porn on your phone? Texting? Or your kid unbuckled their seat belt and your trying to get them locked in again? What’s an acceptable distraction to cause a death that goes into accidents happen on the road?
