yep. His play here is to try to claim that the Ali Act doesn't let the UFC forbid him from boxing.
I'm not a lawyer, and I've seen lawyers argue both sides of this so I don't have a strong opinion on whether he's got a case or not.
If Conor actually prevailed and successfully got a judge to say he can box over the UFC's objections though, I can see the UFC going "ok fine, **** you then, go box". He's not a professional boxer, if he does poorly then in the end he hurts himself.
