Oscar Pistorius Trial
I did a search and didn't see a thread on it.

Anyone else following this?

I'm truly baffled by this case. The defense isn't great but the prosecutors aren't proving that it was "murder".

Also interesting to follow a court system in another country.

You know, barring actual evidence of an intruder, it's ridiculous that the possibility exists that he wouldn't get murder.

His picking up of the victim card destroyed all give a **** for me.

I feel that way to a sense, but the prosecutors haven't proven that it was actual murder.

Semantics get in the way of everything. He admitted to everything except frame of mind. If frame of mind is a righteous defense I need to let alot of abused women know.

He shot her to death and they were known to be having some very angry arguments recently.

His story is also ridiculous. It should be an easy conviction. I don't know what the rules of court and burden of proof is in South Africa, but in the US you only need to prove guilt beyond a reasonable doubt.

Some people get that wrong and think you have to prove guilt "beyond a shadow of a doubt", but that phrase does not exist in the law. Many murder cases have a defense where the explanation or alibi could theoretically be possible, but you have to ask yourself if its reasonable to believe that it could be true, given what we do know about him: that he's a stupid hothead, and the problems he was having with his girlfriend. If its not a reasonable doubt, he's guilty.

Due to his breakdown on the stand, the trial is being adjourned until tomorrow.

This court is so weird, doesn't make sense at most times.

I just read that this isn't a jury trial, a judge is going to decide the verdict.

On top of that, the judge will also have the option of a lesser charge even if he or she buys Oscar's story that he thought that there was an intruder in the bathroom.

So, here's what the flowchart looks like.

1) Do you think Oscar really didn't know his girlfriend was in the bathroom?

No: Murder
Yes: go to question 2

2) Assuming Oscar believed some intruder was in his bathroom, were his actions reasonable?

No: Some lesser charge, similar to manslaughter in the US.
Yes: Not Guilty

Given all that, and that this is a bench trial, isn't he kinda toast here?
