Who's in the Wrong?

Bought some furniture on March 3rd. I was told by the sales rep/manager that it would take 4-6 weeks for delivery. I waited almost 8 weeks and never heard a word so I went back to the store and the manager said the reason it was taking so long was because they originally sent the wrong purchase order number to their vendor, and that it would be another 7-10 business days. I told him this was unacceptable and just wanted my money back. He agreed and said I would receive a check in three business days.

Yesterday he called me and said he could not refund the money, but could give me store credit. I told him I just wanted a refund and he said he would call me back. Today a different manager called and said they could issue me a refund minus a 20% restocking fee (almost $300). They are trying to use the excuse that they are losing money because they still had to purchase the furniture from their vendor. I said that's not my problem, I bought the furniture from them...not their vendor. They can still sell it to someone else and still profit.

Any suggestions on what my next course of action should be? Im sure someone here will try to twist this and claim its somehow my fault and I should have to pay the restocking fee...

It's absolutely their screw up. And there shouldn't be a restocking fee because it's never been de-stocked.

Yes, in as much as you may have to fight off legal claims. Any time you wind up with legal claims you're in a gray area where you can lose even if you're right.

As to the original point: They're clearly wrong. However, if they're claiming you owe a restocking fee then that must mean they either have the furniture or it's near being delivered. Do you still want it? Are you refusing delivery just because you're pissed off at the retailer?

You're going to lose this one. I'd take the furniture and see if you can get a freebie somewhere. Were they going to charge you for delivery? If so, maybe you can work that charge down.

If you don't want it simply because you're pissed off then you probably still don't have a leg to stand on legally, but it seems silly to me to blame the furniture you want for the treatment a retailer gave you.

Nebraska Furniture Mart and I are through because of how they handled the backorder on my TV. I still took the TV when it finally arrived. I don't hold it against my TV that it was late.

Failing to deliver on time is NOT a minor error. That isn't excused in any business other than retail, and I don't know why the general public puts up with it.

Unless the order he signed says the time frame of when he'll receive delivery. If it says 6-8 weeks and it's been more than that, then the deal is basically voidable, I would think.
