I think it will be just a matter of time before there is no Big 12 conference, mostly because of the assholeness that is UT. I just hope that when it goes down, there is a different AD at Mizzou because Alden will undoubtedly screw it up and they'll end up somewhere like the Mountain West.

My understanding, and this just comes from a blog that I read, is that these contracts are written to the benefit of the network, not the conferences. While I suspect the networks would readjust the total amount of the contract while effectively guaranteeing the remaining schools the original cut, this still doesn't necessarily cover damages from the fact A&M is now no longer available to FOX, which means a market decrease in most cases which could affect their advertising negotiations.

Its just hard for me to imagine a school that had allowed an entity (the conference) to negotiate a new contract for them and then just walks away because it feels it can get a better deal somewhere else to the detriment of one of the parties isn't going to get off that easy. Last year, the 2nd tier rights were ending and the networks had already gotten some value for the 1st tier. This is a little different situation.

The contract is between the network and the conference. Once aTm leaves, they aren't part of the conference. aTm has their own contract with the conference that outlines the penalties for breaking the contract. Beyond those penalties, it really isn't aTm's concern.

That makes some sense. My guess, then, would be they would be in a much weaker position to negotiate those fees down than Colorado and Nebraska due to the relative newness of the agreement?

I doubt if FOX has any basis for a lawsuit. They have the option to void the contract if it doesn't work for them anymore. It's the Big 12 that would be damaged if their product is no longer attractive enough for FOX to honor the contract.

But I'm skeptical about the Big 12's basis for a lawsuit too. When Nebraska and Colorado left, the "penalty" they had to pay was a pre-agreed amount in lieu of actual damages and I'd imagine that the same type of arrangement is in place here too.

Of course, all of this is speculation and the truth depends on what the contracts actually say.
