IMHO then, she shouldn't be fired for the photos, but she could be fired for lying (if they need to state a reason for firing her and assuming she lied).

Several photos have now surfaced showing 26-year-old Victoria James posing nude.

Tuesday night James told CBS12 that the photos of herself were not explicit, but rather tasteful.

Meantime, CBS12 has just learned that James, who's also known as Olivia Sprauer, was arrested last year for battery after allegedly hitting her former husband with a baseball bat.

Police say the couple got into a heated exchange after Max Sprauer said he was talking to another woman.

According to the police report, James smeared peanut butter on the ceiling and bed, and then picked up a bat and hit her husband. This, as the couple's two children watched. She claims her husband was coming after her and she was defending herself
