Dumervil and Broncos turned down on appeal

NFL turns down Broncos' appeal for Elvis Dumervil; Ravens now want him
In his first act as agent for Elvis Dumervil, Tom Condon approached the NFL office with Broncos football operations boss John Elway at his side.

Condon and Elway asked the league office to recognize the agreement on a revised three-year, $30 million deal negotiated, and verbally approved, by the Broncos and Dumervil on Friday.

When the exchange of documents missed the 2 p.m. Friday deadline, the Broncos released Dumervil to avoid paying a $12 million guarantee. Dumervil in turn fired his agent Marty Magid and replaced him with Condon, who is widely considered the most powerful agent in sports.

The Broncos already had made a plea to the league office Friday and were denied. Even Condon's influence couldn't sway the league as the Broncos and Dumervil were rebuffed again.

It was worth a try, but a long shot as the league likely would become inundated with hundreds of contract-bending agreements if it made an exception for the Broncos and Dumervil .

"All contracts are reviewed by our office," NFL commissioner Roger Goodell said at his owners meetings news conference Monday. "If there is something significant they'll bring it to my attention, but those are done as a matter of course."

Would he care to share his personal reaction to the foul up?

"No," Goodell said.

So where does that leave the Broncos and Dumervil? In a completely different arena. Dumervil is now a free agent and the Broncos no longer have sole negotiating rights.

Then again, the Broncos also no longer have the wherewithal to make the same offer. Elway and Condon have continued to talk, but the $4.9 million dead money hit the Broncos received against their $123 million payroll cap is a snag in negotiations.

The Baltimore Ravens are also negotiating with Dumervil, according to an NFL source. Dumervil received a strong recommendation of skill and personal character from Ravens linebacker coach Don "Wink" Martindale.

Yeah, agreed. I think they're disappointed that it didn't work out, and I'm sure they wish the NFL had let it happen. However, they were prepared to let him walk, and thought that was the case prior to the agent/Dumervil changing their mind at the last minute. That's not their fault.

The reworked contract would have paid Elvis $30M over three years, if he had played it out (unlikely).
If Dumervil does return, we'll be surprised to see him get more than $15M over two years, or $20M over three.
Vic Lombardi says the dead money and cap won't be as big an issue as the handwringers are making them out to be. Of course, we've been telling you that since the moment the news of Elvis's release first broke.

Agent Marty Magid is defending his conduct last week in representing former client Elvis Dumervil, saying that his email agreement to accept a contract offer from the Denver Broncos was sufficient under the rules of the NFL’s collective bargaining agreement. Attorney David Cornwell said Tuesday that he has contacted the NFL Players Association to discuss the matter, hoping that the union will examine the case on behalf of both Magid and possibly Dumervil, who’s now a free agent…
...The issue is important on multiple levels. First, Magid is hoping to maintain his standing as a certified agent with the NFLPA. Second, any legal claims by Dumervil if he is unable to get $8 million this season would possibly be directed at the Broncos or the NFL rather than Magid, who has been fired by Dumervil. There is also some concern that the estate of the late agent Gary Wichard could pursue legal action in the Dumervil case. Because Wichard, who died in 2011, negotiated Dumervil’s original deal, his estate (and not Magid) may be entitled to the standard 3 percent commission from the contract. In this case, that would have been $240,000. A person close to Wichard’s family said Monday that Wichard’s estate would likely look into the matter.
Hard to pick sides on this one, but one thing's for sure: the lawyer always win.
