This is incorrect. He broke his leg last year in two places after wrecking on a dirt track, and he caused a huge wreck on that very track (also last year, I believe).

Doesn't matter whether it was his first or millionth time in a sprint car. His actual "throttling" during a yellow flag when no one else was throttling shows malice to send a message whether it was just spraying dirt or intentionally trying to hit him. Malice comes in all flavors and at all levels. This is what the prosecution will try to say IF it goes to trial.

Tony will say he "throttled" in order to miss the kid
