Report: Tom Brady destroyed his phone. Appeal has been denied.

The NFL is going to reject Tom Brady’s appeal and uphold the four-game suspension he is facing for his alleged role in Deflategate, according to one report.

Stephen A. Smith said on ESPN’s “First Take” Tuesday morning that a source told him Roger Goodell will not reduce or overturn Brady’s suspension. Perhaps more shocking, Smith cited a separate source who told him Brady actually destroyed his own personal cell phone rather than just refusing to turn it over.

We have known all along that the bigger issue here is Brady’s lack of cooperation during the Ted Wells investigation. The NFL was furious that Brady wouldn’t give up “relevant” text messages and emails that might help clarify his level of involvement — or lack thereof — in Patriots equipment managers allegedly letting air out of game balls.

Smith clarified that he was told by one source that the NFL is going stand by its four-game suspension within the next 24-48 hours, whereas the information about Brady destroying his cell phone was just “something I heard.” It was almost as if he was downplaying the information knowing how much of a bombshell the rumor was.

Reports in recent weeks have been all over the place regarding Brady’s appeal. There has been some indication that the two sides are working toward a settlement, though reports like this one make that seem unlikely.

If the NFL upholds the suspension, no one would be stunned. If someone can prove that Brady destroyed his cell phone, that would be tough for the New England Patriots quarterback to explain.

It depends on the precise arguments Brady makes in his appeal, but if he doesn't directly challenge the conclusions of the Wells report then nothing on the phone could be material to any issue or defense involved in the proceeding.

That is a path he may very well take.

If he takes a path that involves challenging the Wells report, then the entire process may well become open to reinvestigation, in which case the proceeding could easily take years, and yes the phone and all other data/documetns would be discoverable.

Roger Goodell ****ed this up, just like he ****s up everything. Inconsistent punishment, stupid decisions but more importantly, the dumbshit couldn't even hire someone outside the NFL's sphere of influence to investigate a troubling claim by the Colts and Ravens.

IMO, the whole thing should be thrown out, along with Goodell. It's completely biased, ignores evidence and interviews and will likely make the league office look even worse after it's all said and done.

Good lord. If all this is true his butt has sealed his fait in the public eye as being a liar and a cheat for sure. There would be no other reason to destroy his own phone. Goodall burned the walk through tapes and now Brady has killed his own phone. Must have been some bad shit on it. Real bad.

Because like any other seemingly monolithic organization, the NFL is made up of human beings.

Name one reaosn why the initial leaks, which said that all 12 balls were 2 pounds under weight, were never denied, even though that was absolutely false.

The whole thing was launched by the Colts, who hate the Patriots, and a senior NFL executive who whose father was Presidnet of the Jets, and who himself worked for the Jets when BB stiffed them and walked out the door to join the Patriots.

Whatever, I'm not much of a fan of conspiracy theories.

I am a fan of science, which doesn't well support ANY deflation.

I couldn't give two shits about Brady.

But the report, which took a ridiculous amount of time to produce, completely disregarded Walt Coleman and therefore, the report is worthless.

I'm not a big fan of conspiracy theories, whether it's 9/11 or Deflategate. Are there elements in the NFL that hate the Patriots? Sure. Did the Colts intentionally spread the leaks about deflategate? Obviously. Did the NFL fail to quelch intentionally false exaggerations of the extent of deflategate? Obviously.

But I don't believe Wells or his team hates the Patriots. I think they're poor scientists at best, that the science doesn't support intentional deflation (because the deflation, which obviously did occur) is well within what the ideal gas law would provide, that the report used numerous leaps of logic (especially in ignoring the critical evidence provided by the game-day ref).

Whatever, we've had this debate, and as I've said, I'm well past it. The reputational damage is done, and nothing will change that now.

To me it's pretty obvious there was a cover up, he did ask and footballs were in fact tampered with. The league also agrees so.....
