Report: Tom Brady destroyed his phone. Appeal has been denied.

The NFL is going to reject Tom Brady’s appeal and uphold the four-game suspension he is facing for his alleged role in Deflategate, according to one report.

Stephen A. Smith said on ESPN’s “First Take” Tuesday morning that a source told him Roger Goodell will not reduce or overturn Brady’s suspension. Perhaps more shocking, Smith cited a separate source who told him Brady actually destroyed his own personal cell phone rather than just refusing to turn it over.

We have known all along that the bigger issue here is Brady’s lack of cooperation during the Ted Wells investigation. The NFL was furious that Brady wouldn’t give up “relevant” text messages and emails that might help clarify his level of involvement — or lack thereof — in Patriots equipment managers allegedly letting air out of game balls.

Smith clarified that he was told by one source that the NFL is going stand by its four-game suspension within the next 24-48 hours, whereas the information about Brady destroying his cell phone was just “something I heard.” It was almost as if he was downplaying the information knowing how much of a bombshell the rumor was.

Reports in recent weeks have been all over the place regarding Brady’s appeal. There has been some indication that the two sides are working toward a settlement, though reports like this one make that seem unlikely.

If the NFL upholds the suspension, no one would be stunned. If someone can prove that Brady destroyed his cell phone, that would be tough for the New England Patriots quarterback to explain.

Yep, quite possibly. I just wish the actual science backed up the deflation more strongly.

Whatever. It is what it is. This will play out in court for a while. The NFLPA may try to dismiss the case and/or move venue, which could take some time before the actual merits of the case even get reached.

The science does back up the deflation.

There's just a slim chance, if everything went perfectly, that the same results could be achieved without deflation. That does not mean that the science doesn't fit with intentional deflation.

The standard rule for an injunction like that would be that the moving party is 'likely to prevail' on the merits of their claim.

I'm not certain that a judge will grant the injunction. The irreversible harm element will be pretty straightforward but I'd imagine that 2nd part is going to be a pretty tough hurdle to clear.

Look, I think this weakens Brady's case but it's not an automatic admission of guilt anymore than pleading the Fifth. I know it's a red flag, especially to the haters and even Goodell. Odd, that this was not mentioned in the report by Wells. To my knowledge, and I could be wrong, it happened at the time he was interviewed when under investigation by Wells. Brady, says he destroys his cell phone after so many uses. The information would also be on other people's phones too.

Goodell isn't the brightest bulb and is a jerk. I'll take Brady's word over Goodell's anyday as there is nothing in his past showing he's a liar—unlike Goodell.

NFL has filed a confirmation court motion in New York to keep case out of NFLPA favorable locations of Minneapolis or Brady's home state.

Brady has given approval to the NFLPA to file appeal.
