Report: Tom Brady destroyed his phone. Appeal has been denied.

The NFL is going to reject Tom Brady’s appeal and uphold the four-game suspension he is facing for his alleged role in Deflategate, according to one report.

Stephen A. Smith said on ESPN’s “First Take” Tuesday morning that a source told him Roger Goodell will not reduce or overturn Brady’s suspension. Perhaps more shocking, Smith cited a separate source who told him Brady actually destroyed his own personal cell phone rather than just refusing to turn it over.

We have known all along that the bigger issue here is Brady’s lack of cooperation during the Ted Wells investigation. The NFL was furious that Brady wouldn’t give up “relevant” text messages and emails that might help clarify his level of involvement — or lack thereof — in Patriots equipment managers allegedly letting air out of game balls.

Smith clarified that he was told by one source that the NFL is going stand by its four-game suspension within the next 24-48 hours, whereas the information about Brady destroying his cell phone was just “something I heard.” It was almost as if he was downplaying the information knowing how much of a bombshell the rumor was.

Reports in recent weeks have been all over the place regarding Brady’s appeal. There has been some indication that the two sides are working toward a settlement, though reports like this one make that seem unlikely.

If the NFL upholds the suspension, no one would be stunned. If someone can prove that Brady destroyed his cell phone, that would be tough for the New England Patriots quarterback to explain.

Destroying the phone doesn't even make much sense. He isn't obligated to turn it over. He destroyed it why, then?

But not much about Deflategate ever made sense...

This is basically the Watergate Theorem: the coverup is worse than the crime. If he just said he liked to play with balls that are lower on the pressure side, but he didn't know the exact pressure, then he probably just gets a stern look and they move on.

Instead, he's so unwilling to cede an inch that he obstructed and investigation and lied to the people performing it. That's what he's getting punished for, and it's what he should be punished for.

at this point, I don't really give a shit

The NFL isn't going to simply suspend Tom Brady, the golden boy of the NFL, just because. It's horrible for the league. He's literally an icon.

He clearly broke the rules. He clearly did so intentionally. It's the Patriot way. The NFL doesn't just going around suspending their glamour boys. You really think they wanted to suspend a guy who is arguably the greatest QB of all-time so that, for the rest of his life, he'll have to talk about the one blemish on his HOF career?

Except there is no obligation on players to cooperate. No rules at all around that. Not in the CBA.

That's part of what the federal case will be about. In the end, we'll see what the judge says.

Actually I'm over it. The reputational damage is done. Can't put that toothpaste back in the tube. Now it's an interesting question of procedure and process, which ultimately Judge Doty or another federal judge will ultimately decide.

And most people here don't even know, or care, that the Wells Report isn't really even part of the challenge. That the questionably science that underlies the entire case can't even be challenged. It will come down to the NFL's own process and the requirements of the CBA.

I got four rings of memories, which is exactly four more than I ever really expected to see. Might get more before BB and Brady are done too, but I'm pretty happy with what I've gotten to watch the last 15 years, to say the least.

Cops talk about 'failing the attitude test' on occasion. If you're an asshole to the officer, they'll look for something to hang on you.

The Patriots and Tom Brady unquestionably failed the attitude test here. Kraft came out and told the league to lick his taint, Brady obstructed every chance he got. When that's the approach you take, you can bet that the shield is going to dig in twice as hard to hang one on you.

The Patriots and their leadership are just so friggen haughty and holier than thou that they figured they'd just shake their dicks at the NFL and Goodell would take it. Oops...kinda overplayed your hands there fellas.
