The NFL is going to reject Tom Brady’s appeal and uphold the four-game suspension he is facing for his alleged role in Deflategate, according to one report.

Stephen A. Smith said on ESPN’s “First Take” Tuesday morning that a source told him Roger Goodell will not reduce or overturn Brady’s suspension. Perhaps more shocking, Smith cited a separate source who told him Brady actually destroyed his own personal cell phone rather than just refusing to turn it over.

We have known all along that the bigger issue here is Brady’s lack of cooperation during the Ted Wells investigation. The NFL was furious that Brady wouldn’t give up “relevant” text messages and emails that might help clarify his level of involvement — or lack thereof — in Patriots equipment managers allegedly letting air out of game balls.

Smith clarified that he was told by one source that the NFL is going stand by its four-game suspension within the next 24-48 hours, whereas the information about Brady destroying his cell phone was just “something I heard.” It was almost as if he was downplaying the information knowing how much of a bombshell the rumor was.

Reports in recent weeks have been all over the place regarding Brady’s appeal. There has been some indication that the two sides are working toward a settlement, though reports like this one make that seem unlikely.

If the NFL upholds the suspension, no one would be stunned. If someone can prove that Brady destroyed his cell phone, that would be tough for the New England Patriots quarterback to explain.

It would be damn funny if yet again Patriot arrogance led Brady and co. to believe they could talk big and get Goodell to cower. Shit, it usually works...why not now? But when Brady's people came out and started leaking the 'lift it entirely or no deal' rhetoric, I have to think the NFL decided to stand firm.

They just keep whipping it out and being surprised when the NFL doesn't mind cutting it off.

The only thing that could make it better would be if he takes it to court and that pushes back the 4 game suspension. Shit comes down to the wire and the court upholds the ruling....just in time for Brady to be suspended for the playoffs.

Sounds like the NFL is trying to take the fight to Brady. Looks like they filed a petition for confirmation from the federal district court pretty much simultaneously with their ruling.

Yeah, found a guy on reddit that claims to know what he's talking about, and he says that the CONTENT of text messages is only kept for a few days. It's only the basic info about sender and recipient that's kept for a long time.

This is only happening because of how the entire Patriot's organization acts when it comes to this type of shit. If they didn't act like entitled assholes who are above the law.....they wouldn't have gotten it this hard. They pretty much tied the NFL's hands.

On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cell phone he had used for the prior four months be destroyed. He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. ‎During the four months that the cell phone was in use, Brady had exchanged nearly 10,000 text messages, none of which can now be retrieved from that device. The destruction of the cell phone was not disclosed until June 18, almost four months after the investigators had first sought electronic information from Brady.

Sort of the opposite of what you're saying, actually. They are trying to make sure they get the forum they want. Tired of getting their asses kicked in Minnesota. Sort of signals that they aren't confident they would win in Minnesota.

Smart move though. And if the judge is from New York and is a Giants or Jets fan, that can't hurt either... Judges are people too.
