Really sorry to hear about that, Mikey.
I have 3 attorneys that I use for my business dealings. A good attorney and good accountant are the two things I NEVER scrimp on. My best to your folks in retrieving as much as they can.

Sorry man, I feel ya.
I took care of my deceased father's best friend when I got out of the Army. I moved him in, got him mental/physical care, gave him a car and fixed his house. I literally had to shovel feces out of his house (had a bathroom issue and was going in his kitchen, the guy was out of it but I did not know how bad until I got out) After all of the work to get his house up to code, get his medical benefits started and some monthly cash from big brother, he passed away. As far as I knew, he had no living family. He had told me when I was a teenager he wanted to give me all he had when he passed. (when he was younger he was a scientist and major militiaman/gun collector) I knew the law office he had some of his stuff through, they could not find a will that divided up his assets, but stated they remembered my name for some reason. In the end, the house and all items went to some very old uncle that he had whom he'd never met. The guy didn't even give me my first set of dog tags and first maroon Airborne beret I had given to my dad's friend during my time in service. He said it wasn't my "problem" anymore and to just leave him alone. I saw the house on the market 6 months later. Oh well, sucks but if you never had it, you'll never miss it. And yes, I did get butt hurt that I didn't get all of the stuff that I thought I would get. I did not help him on that premise but it sure would have been nice. Later, life was nice enough to through me happy points for my good deeds and I live better than I could ever imagine now. |

That really sucks man, but to me that's just as much your parents' fault as it is the attorney's for not following up and making sure the will was filed before said deadline. When there is $500K at hand...you can bet your ass I'm following up at least 1-2 times a week to make sure everything is handled and I would have checked numerous times w/ the clerk's office to make sure it's been filed. Another words just taking someone's word for it isn't enough. Hope for the best for your parents..that is indeed a shitty situation.

Failure to do so, and failure to notify the client of that fact in a timely manner is 100% on the attorney. My parents were flat out LIED to numerous times during the process.

I mean your parents went on vaca and just assumed all was done and didn't worry about it. No offense but I think that's pretty careless.

That's a terrible story. Sorry to hear this, and hopefully there can be SOME sort of rectification here. At least reimbursement of some expenses and action against the attorney.
Whatever happens and whatever its worth, your parents showed great character and honor in caring for this man and being there for him. I'm sure God honors them for that, but that's just me. |

Sorry, dude...but your parents have to take at least some of the fault for accepting the attorney's word numerous times over a span of 6 whole months without demanding to see something IN WRITING that proved to them that the matter had been taken to court.
