As soon as you inform them they're being recorded they either combat you over it (unlawfully) or they stop acting like assholes. The latter is more common now since they've been forced to learn the laws about it.

Slow trucks watch cars pass all day long. You can tell who is doing the speed limit or 5 over compared to 10+. The driver probably saw him driving faster than the flow of traffic, paid more attention to the obvious safety hazard and saw threw his mirror (which looks down into cars windshield) that the driver was talking on the cell in a state that does not allow cell use.
